Terms of Use

These Terms of Use ("Terms") govern your access to and use of Lemon Tree — the website, mobile apps and related services (together, the "Service") that help people around the world find local roadside stalls, honesty boxes and backyard growers, and help growers list what they have to share or sell.

The Service is operated by Lemon Tree ("Lemon Tree", "we", "us" or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Lemon Tree is a discovery directory, not a shop. We are not the seller of any produce listed on the Service and we are not a party to any transaction between a buyer and a grower. Please read section 6 carefully.

1. Who can use Lemon Tree

You may use the Service if you are at least 16 years old (or the minimum age required to use an online service where you live) and able to form a binding contract. If you use the Service on behalf of a household, stall or business, you confirm that you are authorised to accept these Terms for them.

2. Your account

You sign in using a third-party identity provider (Google, Facebook or Apple). We do not store a password for you. You are responsible for keeping access to your chosen sign-in method secure and for all activity that happens under your account.

• Give accurate information and keep it up to date.
• Do not share your account or let anyone else use it to impersonate you.
• Tell us promptly if you believe your account has been accessed without your permission.

3. Using the Service responsibly

When you use Lemon Tree, you agree that you will not:

• break any law, or infringe anyone's rights (including privacy and intellectual property rights);
• post content that is false, misleading, deceptive, offensive, harassing, or that you do not have the right to share;
• list produce or goods that are unsafe, illegal to sell, or that you are not permitted to supply where you live (for example, alcohol, certain regulated or unsafe foods, or items subject to import, export or biosecurity controls);
• misrepresent a stall's location, availability, pricing or ownership, or create listings for stalls that are not genuine;
• collect other users' personal information, send spam, or use the Service to advertise unrelated products or services;
• interfere with, scrape at scale, overload, or attempt to gain unauthorised access to the Service or its systems; or
• use the Service to stalk, threaten or endanger any person, or to trespass on private property.

When visiting a stall you find through Lemon Tree, respect the grower's property, follow any on-site instructions, and use good judgement about your own safety.

4. Listing a stall

If you list a stall, you are the "grower" for that listing. You are solely responsible for the listing and for anything you sell or share through it. You confirm that:

• you own or have permission to operate the stall at the location you provide;
• your listing — including produce, prices, availability, photos and description — is accurate and kept reasonably current;
• your produce is safe and lawful to supply, and you comply with all applicable food safety, labelling, tax and local council requirements; and
• you are responsible for handling payment (including honesty boxes and any self-serve arrangements) and any refunds or disputes with buyers.

We may review, decline, reorder, hide or remove any listing — for example, to keep the Service trustworthy, to comply with law, or where a listing appears to breach these Terms. Approval by us is not an endorsement or a guarantee that a stall or its produce meets any standard.

5. Your content

You keep ownership of the content you submit — including stall details, photos, product information and notes ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example, to resize images), publish and display Your Content for the purpose of operating, promoting and improving the Service. This licence continues for as long as Your Content is on the Service and for a reasonable period afterwards for backups and legal compliance.

You are responsible for Your Content and confirm you have the rights needed to grant this licence. Do not upload photos of identifiable people without their consent.

6. Transactions between buyers and growers

Lemon Tree helps buyers and growers find each other. Any sale, exchange or gift of produce is a matter solely between the buyer and the grower. We are not a party to it, we do not process payments, and we do not take a commission.

• We do not guarantee the quality, safety, availability, legality or accuracy of any produce or listing.
• We are not responsible for pricing, payment, pick-up, refunds, or any dispute between a buyer and a grower.
• Any consumer guarantees or obligations that apply to a sale under the consumer protection laws of the country where the grower and buyer are located are the responsibility of the grower.

7. Following and notifications

You can follow stalls to save them and, where available, receive updates about availability. You can stop following a stall at any time, and manage notification preferences through your device or account settings.

8. Our intellectual property

The Service, including the Lemon Tree name, logo, design, text and software, is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell or reverse engineer any part of the Service except as permitted by law.

9. Third-party services

The Service relies on third parties — including identity providers (Google, Facebook, Apple), Google Maps for mapping and location search, and hosting and analytics providers. Your use of those features may also be subject to the third party's own terms. We are not responsible for third-party services and links.

10. Availability and changes

We are still growing, and we may add, change, suspend or remove features at any time. We try to keep the Service available but we do not promise it will be uninterrupted or error-free, and we may carry out maintenance without notice.

11. Disclaimers

To the extent permitted by law, the Service and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that listings are accurate, that stalls are open, or that produce is available or fit for any purpose.

Nothing in these Terms limits any rights you have under mandatory consumer protection laws that apply where you live and that cannot lawfully be excluded. Some countries do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Lemon Tree and its people will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, data, goodwill or opportunity, arising out of or in connection with your use of the Service, any listing, or any dealing with another user. Where our liability cannot be excluded but can be limited, our total liability to you is limited to USD $100 (or its equivalent in your local currency).

13. Indemnity

You agree to indemnify Lemon Tree against any claims, losses, liabilities and reasonable costs arising from Your Content, your listings, your dealings with other users, or your breach of these Terms or of any law.

14. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if it is necessary to protect the Service or other users, or if required by law. Sections that by their nature should survive termination — including content licences already granted, disclaimers, limitations of liability and indemnities — will continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will take reasonable steps to let you know, such as posting a notice in the app or updating the date above. By continuing to use the Service after changes take effect, you accept the updated Terms.

16. Governing law

Lemon Tree is available internationally. These Terms are governed by the laws of New Zealand, where Lemon Tree is based, without regard to conflict-of-laws rules, and you submit to the non-exclusive jurisdiction of the New Zealand courts. This does not deprive you of any protection given by mandatory laws of your country of residence, and you may also be able to bring proceedings in your local courts where the law requires it.
